As an online service, we do not require you to physically sign a lengthy contract. Your use of this website constitutes your agreement to our Terms of Service (“Agreement”). If you disagree with any of these terms, please discontinue using our services.

Terms for Real Estate Professionals

Real estate professionals using our website must adhere to the following terms:

  1. Permission to Display Information: You grant RateMyHome permission to display information related to your real estate transactions, helping potential clients understand your specialties.

  2. License and Legal Compliance: You are responsible for maintaining your real estate license and complying with all applicable laws regarding disclosures, documentation, and brokerage responsibilities. You agree to indemnify RateMyHome from any claims arising from your brokerage services.

  3. Termination of Participation: Participation in our service is voluntary and can be terminated by either party at any time with written notice.

  4. Contact and Recording: You agree to be contacted by RateMyHome and its referrals via phone, email, mail, or other means. Calls may be recorded for quality assurance purposes.

  5. Accuracy of Information: You must provide accurate and complete information, updating any inaccuracies promptly. RateMyHome may correct any inaccuracies discovered.

  6. Service Modifications: RateMyHome reserves the right to modify services, terms, or pricing at any time, with advance notice provided. Continued use of our services after notice signifies acceptance of the new terms.

Terms for Buyers and Sellers

Non-professional users, including prospective buyers and sellers, must adhere to the following terms:

  1. Professional Introductions: RateMyHome may introduce you to real estate professionals or investment partners, sharing necessary contact information. By providing your information, you consent to being contacted by RateMyHome and its partners.

  2. Accurate Information: Providing accurate and complete information is essential for our services. RateMyHome reserves the right to suspend or terminate access for those supplying inaccurate information.

  3. Third-Party Transactions: While RateMyHome facilitates introductions, we are not involved in the actual real estate transactions. Real estate professionals conduct these transactions independently, and we do not endorse or know the terms of any agreements.

  4. Voluntary Participation: Participation in our services is voluntary and can be terminated by either party at any time with written notice.

  5. Modifications to Services: RateMyHome may modify services or terms at any time, with advance notice. Continued use of our services after notice signifies acceptance of the new terms.

Additional Terms

Users may upload, submit, store, send, or receive content (“User Content”). By doing so, you grant RateMyHome a license to use, host, store, reproduce, modify, and distribute your User Content for the purpose of operating and improving our services. This license is perpetual and non-exclusive.

You agree to the following:

  • Ownership of User Content: You own the rights to your User Content and ensure it does not infringe on third-party rights.
  • Prohibited Activities: You will not engage in prohibited activities, such as submitting offensive materials, harassing others, or promoting illegal activities.

Limitation of Liability

RateMyHome provides services “as is” and disclaims all warranties. Our liability is limited to the maximum extent permitted by law, and we are not liable for any special, incidental, or consequential damages.

Arbitration and Legal Fees

Disputes will be resolved through binding arbitration, and the prevailing party in any legal action is entitled to recover legal fees.

Severability and Waiver

If any provision of this Agreement is deemed invalid, the remaining provisions continue in full force. Failure to enforce any provision does not waive our right to enforce it in the future.

Governing Law

These Terms of Service are governed by the laws of Auckland, New Zealand, and any disputes will be resolved in the courts of Auckland, New Zealand.
